10-YEAR ANNIVERSARY CONTEST GIVEAWAY RULES & TERMS AND CONDITIONS (THE “CONTEST”)
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE THE CHANCE OF WINNING. VOID WHERE PROHIBITED. BY ENTERING, PARTICIPANT AGREES TO BE BOUND BY THESE OFFICIAL RULES.
1. ELIGIBILITY: Open only to legal residents of any one of the 48 continental United States (excluding Rhode Island) or the District of Columbia who are 18 years of age or older at time of entry. The following individuals are not eligible: employees, contractors, managers, members, directors, officers and owners of Modern Alternative Mama, LLC dba Earthley Wellness, an Ohio limited liability company (“Sponsor”), James Enterprise, Inc. dba Boroux, Vita Bella Cattle, LLC dba Wholestix, Swooney LLC dba Simply Organic Bamboo, Soda Farm, LLC, and each of their respective parents, subsidiaries and affiliated companies involved in the administration, development, fulfillment and execution of this Contest (collectively, “Contest Parties”), and the immediate family members (spouse, parent, child, sibling and spouse or "step") of each and those living in the same households of each such employee, contractor, manager, member, director, officer or owner.
2. CONTEST PERIOD: You may enter the Contest between 12:00:00 am Eastern Time on August 7, 2026 and 11:59:59 pm Eastern Time on August 10, 2026 (“Contest Period”).
3. HOW TO ENTER: To enter the Contest, participants must comment on the designated Contest entry post by @earthleywellness on Instagram (the “Contest Post”), during the Contest Period. Entries that are incomplete, fraudulent or generated by automated means may be disqualified.
Each Instagram handle is permitted only one entry into the Contest regardless of how many times the Instagram handle comments on the Contest Post.
Eligibility is at the sole discretion of Sponsor, and Sponsor shall be entitled to reject any entrant for any reason or no reason at all without having to provide an explanation. Sponsor reserves the right to, in its sole discretion, to cancel, suspend, or terminate the Contest for any reason and without prior notice to any participant. In such instance, Sponsor may, if and as appropriate, select a winner or winners using reasonable means that are materially consistent with these official rules.

RUNNER-UP PRIZE:
Each Runner-Up will receive one (1) 4 oz. Earthley Wellness Lymphatic Cream $14.99, one (1) Boroux large glass bottle and $50 discount code $12 ($50 discount code), five (5) Wholestix beef stick 5-packs $22, and one (1) Simply Organic Bamboo Sleep Mask $34. Each Runner-up prize package is valued at $133.
5. SELECTION OF WINNERS: One (1) Grand Prize Winner and ten (10) Runner-Up Winners will be selected via random drawing on or about August 14, 2026, from all eligible entries received. All winners are subject to verification, including without limitation, verification of eligibility and compliance with these Official Rules.
6. ODDS OF WINNING: The odds of winning depend on the number of eligible entries received during the Contest Period.
7. GENERAL CONDITIONS: Finalists are solely responsible for any taxes on their respective prizes, if any, and will receive an IRS Form 1099 for the taxable value of their prize pursuant to applicable law. No substitution of prize is offered, except at the sole discretion of the Sponsor. Prizes are non-transferable. Unclaimed or returned undeliverable prizes will not be awarded. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. If for any reason the Contest is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion to cancel, modify or terminate the Contest. Further, Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be: (a) tampering or attempting to tamper with the entry process or the operation of the Contest or any Sponsor or Contest-related web site; (b) violating the Official Rules; or (c) violating Instagram terms of service, conditions of use and/or applicable general rules or guidelines. This Contest is offered only in the United States and is governed by the laws of the state of Ohio.

8. WINNER NOTIFICATION: Winners will be notified via Instagram tag to the winning Instagram handle and also Direct Message through the Instagram platform, such tag and direct messages to be sent by @earthleywellness within two (2) weeks of the end of the Contest Period. If a potential winner cannot be contacted, fails to respond within five (5) days after the notification tag is posted, is deemed ineligible, or if a winner is otherwise unable to accept their prize, the prize will be forfeited and may be awarded to an alternate winner at Sponsor’s discretion. Winners may be required to sign and return an affidavit of eligibility /publicity release where permitted by law.
9. RELEASE OF LIABILITY: By participating in the Contest, the Participant releases Sponsor and the Contest Parties from any and all claims, damages or liabilities arising from or relating to such Participant’s participation in the Contest. By accepting a prize in the Contest, winners agree that the Sponsor and Contest Parties shall not be liable for any loss or injury resulting from participation in the Contest, acceptance or use of any prize.
10. DISPUTE RESOLUTION: Participant acknowledges and agrees as follows: 1) that all disputes, causes of action and claims connected to or arising in any way from participant’s participation in the Contest shall be resolved on an individual basis (i.e., class action suits are waived by participant), and exclusively by the state or federal courts situated in Franklin County, Ohio; 2) that the laws of the state of Ohio shall apply, without regard to its conflict of laws principles; and 3) that the Contest Parties and the participant waive any right to a trial by jury.
10. PUBLICITY: Except where prohibited by law, participation in the Contest constitutes the winner’s consent for Sponsor or the Contest Parties to use the winner’s name, likeness, and city/state for promotional purposes without additional compensation.
11.
